In accordance with Section 8.33 of the Declaration of Covenants and Restrictions of Versailles at Wellington (the “Association”), as amended the following rules and guidelines were adopted by the Board of Directors on August 20, 2015:
1. Leases shall be limited to one approved lease per year per LOT and each approved lease/rental arrangement shall be for a term of not less than one year and no more than one year.
2. All completed applications for initial and renewal leases must be submitted to the then existing property manager of the Association at least sixty (60) days prior to the actual lease commencement or renewal date as set forth in the written lease. If the application is deemed incomplete by the Association or additional supporting information which has been requested is not provided thirty (30) days prior to the lease commencement date, then an additional fee of $200.00 will be required and due and payable to the Association. If such documentation is still not provided or the application is still deemed incomplete by the Association fifteen (15) days prior to lease commencement or renewal start date, then a second additional fee of $200.00 shall be will be required and due and payable to the Association..
3. If a complete application and all requested additional information are not received at least five (5) days prior to the lease commencement date or renewal date, the application will be denied automatically denied and in the case of a renewal, the gate entry tags will be deactivated. Additionally, in the case of lease renewals, if the Tenant remains in the leased premises beyond the then current lease term, the Association may commence eviction proceedings as against the unapproved tenants/occupants as well as take any other necessary and appropriate action in accordance with the governing documents of the Association.
4. The following criteria must be fully and unequivocally satisfied as reasonably determined by the Association for all initial and renewal lease approvals:
a. Homeowner must be current with regard to all assessments, maintenance, dues, fines, attorneys’ fees, and/or any other monetary obligations to the Association. The homeowner's property must not be the subject of an existing mortgage or lien foreclosure action and not be currently in violation of any of the Association's rules, regulations, the Declaration of Covenants and Restrictions or any aspect of the governing documents of the Association.
b. Credit score of each tenant in an initial lease must be at least 625. For lease renewals, if the credit score falls below 625, then the application for renewal will be approved unless any of the following has occurred:
(i)the tenants or occupants which are the subject of the application for lease renewal has engaged in criminal activity as evidenced by an arrest, conviction, or plea arrangement during the past yearly rental period
(ii), or or any guest or invitee of the Homeowner or the tenant has engaged in criminal activity at the Lot,
(iii) violations have issued, incident reports prepared by Association’s security personnel (involving the tenant, occupant, invitees, or guests where the HOA has believe that any such person was involved in misconduct or other activities in violation of the governing documents) during the past yearly rental period; or
(iv) the Homeowner is delinquent with regard to any portion of the Asssociation assessments, maintenance, dues, fines, attorneys’ fees, and/or any other monetary obligations to the Association.,.
c. No felony convictions within the last ten years for any tenant or occupant.
d. If any tenant or occupant is on the sex offender list, the application will be denied
e. The number of tenants and permanent occupants can not exceed 1 ½ persons per 1000 square feet of living area (under air).
f. The number of pets shall be limited as follows and is in addition to and not in lieu of the pet restrictions provided in the Association’s governing documents:
i. “Dangerous dogs” as that term is defined in Florida Statutes 767.11 are strictly prohibited.
ii. No pit bull dogs are permitted.
iii. One dog no more than 40 lbs. (unless it is a “service animal” as that term is defined in the Americans with Disabilities Act codified at C.F.R. § 35.104 and § 36.104 (2010)
iv. One domestic cat
v. One hamster or one guinea pig
vi. No reptiles or lizards or insects are permitted
